Federal District Court Dismisses Suit Against AR-15 Makers
Chalk up a legal victory for the gun industry. The U.S. District Court (Southern District of Ohio) has dismissed, with prejudice, the Primus Group v. Smith & Wesson, et al lawsuit. The decision was delivered October 9, eliminating the plaintiff’s claims against several prominent AR-15 firearms manufacturers, including Smith & Wesson, Remington Arms Company, SIG Sauer, Sturm, Ruger & Company, Colt Manufacturing, and Armalite.
“This decision by the federal judge to dismiss with prejudice this frivolous case is pleasing, if not unexpected,” said Lawrence G. Keane, NSSF Senior Vice President of Government Relations and Public Affairs and General Counsel. “These are lawful and federally-regulated AR-15 modern sporting rifle manufacturers that make semiautomatic rifles for lawful purposes. The judge was absolutely correct to assert that the proper venue to establish public firearms policy is through the legislature and not the courts.”
Primus Group, LLC, is a small entity in Columbus, Ohio with a vague business model. The limited liability company filed suit after the tragic murders in El Paso and Dayton, Ohio. They claimed racketeering, intentional misrepresentation claims, and “a clear and present danger” of all American lives due to “assault weapons”. The modern sporting rifles manufactured and sold by the companies named as defendants are semi-automatic rifles, meaning one round is fired for each trigger pull.
The court found the plaintiffs had no standing to bring the case against the defendants. This decision rightfully asserts that those who purposefully and criminally misuse firearms are the ones who are responsible for those crimes. It further affirms that activist lawsuits to prompt judicial action are not the proper avenue to establish policy.

Modify the whole system
About time they put blame where it belongs.
Trying to blame the firearms industry for criminal behavior, is like suing the auto manufacturers for vehicle criminal accidents and DWIs, how about suing swimming pool builders for children drownings. When will they learn its the individual criminal behavior .. A firearm is just a tool like a vehicle it can be used lawfully or in a criminal act. Owning a firearm is a constitutional RIGHT ,driving an auto is a privilege.
Which part of “Shall Not Be Infringed” , don’t these so-called intellectual elites fail to grasp ?

When the Left, ergo, socialist, commumists, radical progressives, and democrat rads were not in power, they said nothing about abolishing the Rights empowered to the People in the Second Amendment. Their Red Guards in America and Europe, of the 1960s and 1970s violated every gun law on the books with murder, armoured car and bank robberies.
When they changed tactics and ran for and were elected to offices, they dropped their militant Che Guevera radical chic garb for designer suits and focused professional marketing of themselves as moderate folk just seeking ” change”. They did as Chinas Mao dictated: be as a fish in a large school of fish, blend into the social structure until the right time for Revolution; await orders from above.
Now, when in power, their ” primary colors” really show: pink to Stalinist Red.
Gun posession by citizens is frightening to the Left, as they know that an armed moral populace ultimately will not tolerate their rule and imposed tyranny. Noting in the Second Amendment ever mentions hunting as a Right. The founders knew that they must trust the People, ultimately, to decide when Government must be deposed to …” secure those Rights…”
The Left fears the Citizen, thus the now bold moves to seize every gun in America from every law abiding Citizen. That, from a former Socialist and Civil Rights activist of the 1960s and early 1970’s,
I know these people, as I was once one of them.
Let’s get things straight. Citing car and pool manufacturers is a false comparison, because cars and pools are not designed to kill. A more appropriate analogy is insecticide or pesticide.
Also the Second Amendment qualifies the right for a regulated militia, but since all males have to register for selective services, we are — by modern terms — militia.
Tell these to your liberal nut jobs. They are harder to refute.
It’s time to lift the ban on AR-15s and AK-47 type weapons and large capacity magazine everywhere in the United States.
