Beware Cannabis Question on Federal Firearms Transaction Form

You may live in a state where private use of marijuana has been decriminalized, but you still have to worry about the Federal Government. Use of marijuana (cannabis) is still prohibited under Federal law. Admitting that you smoke dope can and will prevent you from being able to purchase firearms. We raise this point because ATF has modified Forum 4473, the Federal Firearms Transaction Record, to include a new warning. The Shooting Wire explains:
“ATF notified licensees last week that ATF Form 4473… has again been revised. There’s now a warning attached to question 11.e.
11.e is the famous question, ‘Are you an unlawful user of, or addicted to, marijuana or any depressant, stimulant, narcotic drug, or any other controlled substance?’
The warning simply says that use and possession is illegal under federal statute regardless of the state’s rules. Some on social media said, ‘ATF is telling you to mark that answer “no”. Apparently they don’t remember Scooter Libby.
Lying on ATF Form 4473, as noted right above Block 14, is a federal felony — punishable by fines and a term of imprisonment. Want an all-expense paid vacation at Club Fed? If not, don’t mess with the [Federal Government].”

You can print Form 4473 from the ATF’s website at https://www.atf.gov/firearms/firearms-forms. FFL dealers should note that all six pages of Form 4473 must be printed and retained as permanent transaction records.

So someone one prescribed medical marijuana should forget trying to buy a gun.
Forget trying to buy one through a dealer, that is.
In NY all gun sales have to have a background cheak.
I am an FFL and I recently went to a seminar where we were advised that any kind of Medical ID Marijuana sticker on the drivers license was a cause for rejection. Don’t ask, don’t tell!
So who, exactly, is a “user”? If a guy smoked a joint forty years ago in high school, is he a user? If he breathed the air at a pot party, is he a user? If he smoked heavily for decades but quit last week, is he a user? Way too nebulous a term. And for the record, no one has ever been ‘addicted’ to marijuana. Doesn’t happen.
Whats the legality of first purchasing guns and then becoming a user of marijuana? Say you purchased a gun 10 years ago and now you’re using medical marijuana. Does that also constitute lying on 4473? Hopefully not. Or what about if you used it in the past? According to the form “are you a user”. So could you do it in college then “get clean” and no longer consider yourself a user? Are you once a user always a user even if you havent touched it in 5 years?
And what if you stop using it, how long is the cooldown before you’re “no longer a user”? Lets say its 1 year. Then you buy a gun. You can legally say “im not a user” because you aren’t using marijuana. Then you start up again after purchasing. Then you haven’t lied on 4473 have you?
So where does that put all the Nam vets who were prescribed Marinol for side effects of PTSD back in the late 70’s , early 80’s . And whom some of those men and women still use it , and get it from the V.A. ? If you don’t know , Marinol contains Tetra-Hydra-Canabinibinol , the active ingredient in pot , that acts as a “dream interrupter” .They would test positive for marijuana use on a legal script , from the same govt. A paradox , for sure .
