Young v. Hawaii Decision Goes Against Supreme Court Precedents
Speaking about the 9th Circuit’s recent 7-4 ruling in Young v. Hawaii, the NSSF says that upholding Hawaii’s ban on carry ignores the clear language of the Second Amendment and U.S. Supreme Court precedent of the landmark 2008 Heller decision and 2010 McDonald decision, which displayed the exact opposite findings. The Ninth Circuit’s ruling underscores the need for the U.S. Supreme Court to accept firearm-related cases for review to settle the long-standing disputes. Lower courts have failed to apply Supreme Court precedents and are effectively treating the Second Amendment as a second-class right.
“The blatant defiance of the Supreme Court to undermine Heller and hollow out rights afforded to individuals by their Creator and clearly protected by the Constitution is unconscionable,” said Lawrence G. Keane, NSSF Senior VP and General Counsel. “It is with amazing boldness that the Ninth Circuit brazenly sets aside not just the previous findings of the Supreme Court, which legally they are bound to apply, but actively chooses to ignore plain English and refuses to acknowledge the right to bear arms. We look forward to filing an amicus brief when this heads to the Supreme Court.”

It didn’t take long. Democratic Party politicians in Washington are moving to ban semi-auto, modern sporting rifles. During his campaign, Joe Biden promised to ban so-called “assault rifles” and now Democratic U.S. Senator Dianne Feinstein (CA) has introduced legislation to do just that. Feinstein’s New Senate bill, introduced as the Assault Weapons Ban of 2021, is Feinstein’s latest attempt to block gun purchases and scuttle the Second Amendment of the U.S. Constitution. An identical bill has been introduced in the House of Representatives by Congressman David N. Cicilline (D-R.I.).
God forbid Feinstein should craft legislation to actually deal with the crime, drug abuse, homelessness, and crumbling infrastructure in her home turf of San Francisco, California. No, she doesn’t care about that. That’s because she has no answers, and she knows that Democratic-party policies have fostered ALL those problems. So she wants to target guns once again, though there is zero evidence that past semi-auto gun bans have had a measurable effect on overall, national violent crime rates.
• Bans the sale, manufacture, transfer and importation of 205 military-style assault weapons by name. Owners may keep existing weapons.
• Bans any assault weapon with the capacity to utilize a magazine that is not a fixed ammunition magazine and has one or more military characteristics including a pistol grip, a forward grip, a barrel shroud, a threaded barrel or a folding or telescoping stock. Owners may keep existing weapons.
• Bans magazines and other ammunition feeding devices that hold more than 10 rounds of ammunition, which allow shooters to quickly fire many rounds without needing to reload. Owners may keep existing magazines.
• Requires a background check on any future sale, trade, or gifting of an assault weapon covered by the bill.
• Requires that grandfathered assault weapons are stored using a secure gun storage or safety device like a trigger lock.
• Prohibits the transfer of high-capacity ammunition magazines.
• Bans bump-fire stocks and other devices that allow semi-automatic weapons to fire at fully automatic rates.
Senator Feinstein declared: “We’re now seeing a rise in domestic terrorism, and military-style assault weapons are increasingly becoming the guns of choice for these dangerous groups. I’m hopeful that with the new administration and Democratic control of the Senate, we can finally … remove these deadly weapons from our communities.” NOTE: This is disingenuous to say the least. If Feinstein was really concerned about “domestic terrorism” she would be doing something about Antifa and BLM rioters.

Warner (D-Va.), Mazie K. Read those names. Notice that there is not ONE Republican on the list. This anti-gun legislation is pure partisan politics folks, pushed by a biased, career politician and supported by a Democratic Party President who is suffering from dementia. While Feinstein and Nancy Pelosi and Chuck Schumer hide behind fences and razor wire, with thousands of armed National Guard troops serving as their “palace guards”, they seek to destroy your right to armed self-defense as guaranteed by the Second Amendment. Without question, after these corrupt politicians ban all mag-fed semi-autos, they will come after other guns, until their mission of disarming America is accomplished.
* There are certain “carve-outs” in the legislation. The bill exempts by name more than 2,200 guns for hunting, household defense, or recreational purposes. The bill also includes a grandfather clause that exempts all weapons lawfully possessed at the date of enactment.
On Thursday, March 11, 2021 the U.S. House of Representatives passed H.R. 8, a bill that would impose mandatory Federal NICS background checks on ALL firearms transfers, including private sales. Some states, such as California, already have this restriction in effect, but in a few other states intra-family or person-to-person long gun sales are allowed. The House also passed a second gun control measure, H.R. 1446, which would extend the initial background check review period from three to 10 business days. Previously if the NICS check was not completed by the FBI within 3 business days, a sale could (in most circumstances) proceed.
NOTE: H.R. 8 and H.R. 1446 have NOT (yet) been approved by the U.S. Senate, or signed into law. But given Democratic Party control of the Senate and White House, there is a good chance that both these House bills may well become the law of the land.
About H.R. 8 — What It Would Require
This bill would change the law in states where certain types of person-to-person sales do not currently require the purchaser to have a Federal background check. USA Today explained: “The legislation would expand the cases in which a background check is required for the sale or transfer of a firearm, including for private individuals and groups, closing the ‘Gun Show Loophole'[.] The bill would make it illegal for anyone who is not a licensed firearm importer, manufacturer or dealer to trade or sell firearms to another person; current federal law requires background checks only for [sales made by] licensed gun dealers.”
As it stands now, this Universal Background Check bill would not mandate a National Registry of all firearms, but we know that many Democratic Party politicians, including Pres. Biden and V.P. Harris, support a National Registry. This would provide the Federal government with a database of all firearms owned by Americans, along with the location of the guns. Such a Registry would facilitate gun confiscation, as is happening right now in Canada. (READ about Canadian Gun Confiscation.)
NRA-ILA Finds Flaws with H.R. 8 and H.R. 1446
After the House of Representative passed gun control bills HR 8 and HR 1446, on a nearly party-line vote, NRA-ILA Exec. Dir. Jason Ouimet released the following statement:
“These bills are a transparent attempt by gun control advocates in Congress to restrict the rights of law-abiding Americans under the guise of addressing the violent criminal culture in America. The truth, however, is that neither of these bills will do anything to solve that problem. By giving full power to unelected government bureaucrats to indefinitely delay and prevent lawful firearm transfers, H.R. 1446 could ultimately destroy the Second Amendment rights guaranteed to every law-abiding American by turning it into a privilege enjoyed by a select few. H.R. 8, so called ‘universal’ background checks, cannot be enforced without a federal gun registry, will not prevent crime, and will turn otherwise law-abiding citizens into criminals for simply loaning a firearm to friends or family members. If Congress is serious about the safety of law-abiding citizens, it should have passed concealed carry reciprocity so that Americans can safeguard themselves and their families across state lines and throughout our country during these dangerous times.”

New American President Joseph Biden, just three weeks after taking office, called for radical, sweeping gun control measures that could dramatically harm the gun industry and strip away citizens’ rights under the Second Amendment of the U.S. Constitution.
On February 14, 2018, Biden said in a statement that his administration will “not wait for the next mass shooting” but will instead “take action” to “end our epidemic of gun violence.”
According to Guns America Digest: “Biden … wants lawmakers to criminalize private transfers, ban many semi-automatic firearms and accessories in common use, and repeal the Protection of Lawful Commerce in Arms Act, which protects the gun industry from being held liable for the criminal misuse of firearms.”
Biden stated: “Today, I am calling on Congress to enact common-sense gun law reforms, including requiring background checks on all gun sales, banning assault weapons and high-capacity magazines, and eliminating immunity for gun manufacturers who knowingly put weapons of war on our streets”.

The elimination of the Protection of Lawful Commerce in Arms Act could have disastrous consequences for the general shooting sports industry and firearms makers. This is because it would expose gun-makers to civil lawsuits for injuries caused by criminals using guys. As explained by the NRA-ILA:
About the Protection of Lawful Commerce in Arms Act By NRA-ILA
Joe Biden has unveiled his agenda for his first 100 days in the White House, and his list includes an initiative aimed at nothing less than the destruction of the U.S. firearms industry. This is what would happen if Biden succeeds in his pledge to repeal the Protection of Lawful Commerce in Arms Act.
Imagine if firearm manufactures and sellers – even those who strictly followed the laws enacted to regulate their industry – faced potential civil liability every time a criminal misused a firearm. The affect would be similar to holding automobile makers and dealers responsible for injuries caused by drunk drivers. No business, no matter how conscientious and law-abiding, could ever survive being liable for the acts of millions of random people over whom it had no control.
And that is exactly why the law generally imposes no duty on a person or entity to control the acts of third persons to prevent them from causing harm (unless the person or entity has certain types of relationships with those causing the harm or being harmed).
Yet gun control activists in and outside of government hoped to rewrite that principle when it came to the makers and sellers of firearms. During the 1980s and ’90s, a coordinated series of lawsuits against the gun industry sought to hold these businesses responsible for the criminal acts third parties committed with firearms.
This egregious abuse of the legal system to destroy an industry providing constitutionally protected goods and services sparked a bipartisan response from coast to coast. Thirty-four states passed laws to block these suits in their own courts. Finally, in 2005, Congress followed these examples by enacting the Protection of Lawful Commerce in Arms Act (PLCAA) to provide a floor of protection nationwide.
With the Democratic Party taking control of the U.S. Senate, U.S. House of Representatives, and the White House, smart Americans know that aggressive, unconstitutional gun control measures are going to be pushed over the next few years in Washington. There is already a bill, H.R. 127, that would require all gun owners to have a Federal License, to pay $800 annual insurance, and to make the type and location of their guns a matter of public record. (See H.R. 127 Video below). And both President Biden and VP Kamala Harris have said they wish to restrict semi-auto rifles, possibly even with mandatory confiscation.
Given this new political environment, it’s no surprise that Americans are rushing to gun stores in droves. And they are buying vast quantities of firearms of all types — pistols, rifles, and shotguns. There were over 2 million NICS-adjusted gun buyer background checks in January 2021. That’s an increase of 75% compared to January 2020.*
“Americans are continuing to purchase firearms at a blistering pace. That’s undoubtedly connected to President Joe Biden’s plans to attack the firearm industry.
Americans are claiming their Second Amendment rights to provide for their own safety in record numbers.” — NSSF
The NSSF Comments: “January’s NICS figures clearly spell out that the demand of law-abiding Americans to purchase firearms isn’t abating. It is growing. Three of the top 10 weeks and one top 10 single day for the highest number of FBI NICS background checks occurred in January. Taken into context that all but one of the top 10 weeks and four other top 10 single-day records occurred during the 2020, when 21 million background checks were conducted, these are jaw-dropping figures to start the New Year.”
Analysis from Mark Oliva, NSSF Director of Public Affairs:
It can’t be discounted that many of these background checks for the purchase of a firearm are attributed to threats by the Biden administration to enact the most radical and far-reaching gun control agenda ever proposed. Americans are continuing to purchase firearms at a blistering pace. That’s undoubtedly connected to President Joe Biden’s plans to attack the firearm industry by undoing and rewriting regulations and executive actions to target the firearm industry, which started with freezing the publication of the Office of the Comptroller of the Currency’s “Fair Access” banking rule. The Biden administration interfered with an independent government agency to further an agenda and perpetuate the illegal Operation Choke Point by farming it out to corporate banks. That was just the opening salvo.
Mental Lapses by Joe Biden: In the South Carolina Presidential Debate, Biden stated that 150 million Americans have been killed by firearms since 2007. That was completely wrong (it would be roughly 45% of the U.S. population). Biden’s defenders claimed it was a simply an over-statement. At best this stupid error shows that Biden is totally misinformed about gun issues. At worst it shows that 78-year-old Biden is suffering from senile dementia.
President Biden [has also] promised to pursue the repeal of the Protection of Lawful Commerce in Arms Act (PLCAA), weaponize the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) to revoke licenses for minor clerical errors and ban entire classes of firearms from lawful ownership and tax or seize modern sporting rifles (MSRs), or AR-15 style rifles, and magazines in a scheme that would cost those owners an estimated $34 billion for the privilege to own what they already lawfully own.
And the NSSF notes that while the Biden Admininistration is 100% committed to attacking the rights of law-abiding firearms owners, that same administration “has yet to put forth a single proposal to tackle the crime, lawlessness, rioting and looting that has plagued this nation for the year.” Violence and rioting in the name of “equity” and a socialist agenda seem to be fine with Biden, Harris and their advisors.
H.R. 127 — Nightmare Bill Could Destroy Second Amendment
* For comparison, the unadjusted January 2021 FBI NICS figure 4,288,240 reflects a 61.7 percent increase from the unadjusted FBI NICS figure of 2,652,263 in January 2020. Though not a direct correlation to firearms sales, the NSSF-adjusted NICS data provide an additional picture of current market conditions. It should be noted that these statistics represent the number of firearm background checks initiated through the NICS. They do not represent the number of firearms sold or sales dollars. Based on varying state laws, local market conditions and purchase scenarios, a one-to-one correlation cannot be made between a firearm background check and a firearm sale.
With anticipated single-party control of the White House, U.S. Senate, and U.S. House of Representatives, there could be dark days ahead for the Second Amendment and the rights of firearms owners. Joe Biden has declared his desire to ban modern sporting rifles and Kamala Harris has supported the use of Executive Orders to carry out new gun bans and restrictions. This is worrisome to say the least.
The prospect of aggressive, partisan attacks on firearms rights has created concern among gun owners across the nation. We stand now, potentially, on the verge of the most extreme era of anti-gun law-making in this nation’s history. How will America cope with those challenges? Joe Biden and running mate Kamala Harris want to take a wide variety of guns away from Americans. (See DNC Platform.) That may prove difficult because Americans own over 393 millions guns according to a recent story. With 393,300,000 firearms in the hands of Americans, that means that there are more guns than people in the USA.
Biden Buy-Back? What could it really cost?
If the Democrats want to confiscate even 10% of firearms with a $500 average buy-back per gun, that could cost nearly $20 BILLION dollars.
Here’s the math for 10% of total guns: 39,300,000 x $500 buyback = $19,650,000,000.00
Where do these numbers come from? This 393 million number comes from the Switzerland-based Small Arms Survey. While the USA has roughly 4% of the world’s population, we have nearly 40% of civilian-owned guns on the planet, “ranking the U.S. number one in firearms per capita” (source: WAMU.org. According to the NSSF and Gallup polls there are about 105 to 110 million gun owners in America.
Referring to that same SAS survey, Forbes Magazine noted: “The United States has more guns than people and the research estimates that it had a grand total of 393,300,000 civilian-owned firearms in 2017 — 120.5 for every 100 residents. So how does that compare to other countries? India has a population of 1.35 billion and it comes a very distant second in the gun-ownership league with an estimated 71.1 million weapons. China, the world’s most populous country, comes third with 49.7 million. Pakistan is in fourth place with 43.9 million civilian-owned guns while Russia rounds off the top-five with 17.6 million.”

Make no mistake about it — leaders of the Democratic party want to dismantle the Second Amendment and impose devastating new restrictions on gun owners. Companion Bills currently in Congress will require a Federal License to own ANY Firearms. The first line of the identical bills, H.R.5717 and S.3254, mandates a federal license for any American to legally “purchase, acquire, or possess a firearm or ammunition”. Yes you can’t even own ammo without a Federal license. Morever, to obtain such a license, citizens can be subject to psychological/character exams so that bureaucrats can “make a determination of suitability”. Such requirements effectively destroy the Second Amendment. Imagine if you had to obtain a license to vote, or pass a psychological “determination of suitability” before you could attend your church.
These companion bills, which have been endorsed by Joe Biden and his running mate Kamala Harris, represent the greatest legislative threat to the gun rights in the history of the country. Biden himself has called for the banning of AR15s and other modern sporting rifles, while Harris has advocated the use of Executive Action to confiscate semi-auto rifles (as was done recently in Canada).
The Jews for the Protection of Firearms Ownership (JPFO.org) have analyzed these companion bills in Congress. The JPFO states that this legislation’s “character [and] suitability” requirements for licensing would effectively eliminate the Second Amendment: “The Bill of Rights’ ban on infringement would be ignored… Unelected bureaucrats will literally choose who can bear arms [and] all existing arms in private hands will be subject to confiscation.”
The Democratic-sponsored gun control legislation, H.R.5717 and S.3254 will require current and future gun owners to pass psychology and character tests to continue owning the firearms they already legally possess. When asked, legal experts have been unable to describe how this could be applied fairly and predictably. America has an estimated 100 million gun owners. That number has grown dramatically in 2020 because of citizens’ fears over large scale rioting and intimidation by BLM and Antifa, and the demands by Democrats to “defund the police”.
The first line of the identical bills, HR5717 and S3254, requires a federal license for any American to legally “purchase, acquire, or possess a firearm or ammunition”. This is de facto infringement.
To obtain this license you would need to prove to unelected officials that you are of “sound mind and character”, you do not “potentially create a risk to public safety”, and you meet “any other requirements the State determines relevant”. Authorities, “make a determination of suitability”, for your possession and ownership of firearms, including any you currently own.

Gun Violence Prevention and Community Safety Act of 2020
This bill makes various changes to the federal framework governing the sale, transfer, and possession of firearms and ammunition. Among other things, the bill does the following:
— Requires individuals to obtain a license to purchase, acquire, or possess a firearm or ammunition;
— Raises the minimum age — from 18 years to 21 years — to purchase firearms and ammunition;
— Establishes new background check requirements for firearm transfers between private parties;
— Requires law enforcement agencies to be notified following a firearms-related background check that results in a denial;
— Creates a statutory process for a family or household member to petition a court for an extreme risk protection order to remove firearms from an individual who poses a risk of committing violence;
— Restricts the import, sale, manufacture, transfer, or possession of semi-automatic assault weapons and large capacity ammunition feeding devices;
— Restricts the manufacture, sale, transfer, purchase, or receipt of ghost guns (i.e., guns without serial numbers);
— Makes trafficking in firearms a stand-alone criminal offense;
— Requires federally licensed gun dealers to submit and annually certify compliance with a security plan to detect and deter firearm theft;
— Removes limitations on the civil liability of gun manufacturers;
— Allows the Consumer Product Safety Commission to issue safety standards for firearms and firearm components;
With the 2020 Presidential election just 65 days away, and more riots in the streets, it may be time to think about getting that AR-platform rifle. Getting it while you still can. Democratic Party nominee Joe Biden and his VP candidate Kamala Harris both support banning of AR-type rifles. And Biden and Harris have praised Canada’s sweeping semi-auto gun ban carried out by Prime Minister Trudeau through dictatorial executive action (without parliamentary approval). The official Democratic Party Platform includes these provisions:
— Banning the manufacture and sale of ARs and modern sporting rifles
— Halting and criminalizing online firearm and ammunition sales
— Forcing states to require licenses for owning any firearms
— Instituting delay processes for background checks
— Criminalizing private firearm transfers
And during her Presidential campaign (before she was selected as Biden’s VP), Kamala Harris declared: “Upon being elected … I will give the United States Congress 100 days to get their [sic] act together and have the courage to pass reasonable gun safety laws. And if they fail to do it, then I will take Executive Action”. That’s a chilling threat…
Got the message? The Dems want your guns. And the first guns they want to take away are the “evil” black rifles. As Robert “Beto” O’Rourke said famously: “Hell yes we’re going to take your AR15″.
