Everytown Works to Destroy Gun Rights with Nuisance Laws

Everytown gun safety PLCAA NSSF public nuisance statute

Everytown Comes Out from Behind the Curtain
By Larry Keane, NSSF Senior V.P. and General Counsel
For years, gun control organizations have been seeking to dismantle the bipartisan Protection of Lawful Commerce in Arms Act (PLCAA). That’s the crucial federal law shielding firearm manufacturers and sellers from frivolous lawsuits designed to bankrupt law-abiding businesses by blaming them for the criminal misuse of lawfully-sold firearms … and impose gun control through court-ordered settlements. It is what former Clinton Secretary of Labor Robert Reich dubbed “regulation through litigation”.

Gun control advocates have unsuccessfully urged Congress to repeal the law, falsely claiming it provides total immunity from all lawsuits — a falsehood regularly repeated by President Joe Biden even though the media has fact-checked him and said it is not true. In court, these groups have unsuccessfully challenged the PLCAA’s constitutionality. Attorney General Merrick Garland testified before Congress that the PLCAA was Constitutionally-sound, despite the contrary rhetoric coming from The White House and the gun ban lobby. They continue to ask courts to misapply the law’s exceptions (disproving the total immunity claim). All these efforts are designed to open up a new floodgate of frivolous litigation against the industry not seen since the late 1990s and early 2000s. It was that litigation which the bipartisan PLCAA prevents.

Now, the enemies of the Second Amendment have opened up a new line of attack on the PLCAA. Surreptitiously led by the Bloomberg-funded Everytown for Gun Safety, they have convinced a few “Blue” antigun legislatures to pass unconstitutional “public nuisance” (anti-PLCAA) statutes. These statutes attempt an end run around the PLCAA to set the table for a renaissance of reckless lawsuits against members of the industry. NSSF is challenging the Everytown-backed laws in New York, New Jersey, Delaware, California, Illinois, Washington and Hawaii.

Everytown’s masquerade as a champion of responsible firearm regulation is a sham. Their actions speak louder than their hollow words. By actively participating in “public nuisance” lawsuits and championing laws like Hawaii’s HB 426, Everytown lays plain its intention to undermine the PLCAA and smother the firearm industry with irrational restrictions that only erode the Second Amendment rights of Americans and do nothing to make communities safer. Their track record of manipulating tragic events for their own political gain is morally reprehensible.

David Chipman Withdrawn as Nominee for ATF Director

ATF David Chipman Nomination BATFE Second Amendment Foundation

Recognizing that a confirmation vote was likely to fail, the Biden White House has retracted the nomination of David Chipman to head the Federal Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). An aggressive anti-gunner, Chipman has advocated the banning of AR-15s and other popular semi-auto rifles. There were concerns about the handling of his own, issued firearms when he worked for the ATF, and his statements as a paid anti-gun activist were extreme and worrisome. Chipman is currently a paid gun control lobbyist who has worked for Bloomberg’s Everytown, as well as the gun control groups Brady United and Giffords Law Center.

Sen. Mitch McConnell was pleased that the Biden Administration retracted the “terrible nomination of David Chipman”. McConnell noted that it was “absurd that a vocal opponent of Americans’ Constitutional rights was ever picked to run ATF. This is a win for the Second Amendment and law-abiding American citizens.”

Sen. Steve Daines concurred: “I’ve been opposed to David Chipman leading the ATF from the start. He’s an anti-Second Amendment, gun-grabbing radical that should not lead the agency that regulates firearms.”

“The defeat of David Chipman is a victory for all Americans who value the right of self-defense,” said Young Americans for Liberty spokesman Eric Brakey, who added: “Chipman has called for a total ban on private ownership of commonly-owned firearms — like the AR-15[.] President Biden should have never nominated this rabid activist on the payroll of Bloomberg-funded anti-gun groups to lead the ATF in the first place.” And the Second Amendment Foundation’s Alan Gottlieb stated: “This is a great grassroots victory for the Second Amendment.”

Immediately following Chipman’s nomination, Gottlieb said it had the smell of political patronage to the Giffords Law Center gun control lobbying group. He also accurately portrayed the nomination as a declaration of war on gun owners’ rights. “We predicted Joe Biden’s pick would ignite a political firestorm, and it did”, Gottlieb recalled. “The President has been so wrong on so many issues, and the Chipman nomination ranks right up there[.]”

Gottlieb continued: “We’re proud of the grassroots effort to defeat this foolish Biden scheme to put an acknowledged extremist gun ban advocate in charge of ATF[.] This is a major defeat for the billionaire elitists who bankroll the gun prohibition movement.”

The Citizens Committee for the Right to Keep and Bear Arms declared that the withdrawal of anti-gun lobbyist David Chipman’s nomination to head the ATF is “a much-deserved defeat for the gun prohibition lobby and Joe Biden”.

According to Guns America Digest, these anti-gun candidates hope to spend their way into office with heavy funding from anti-gun organizations: “With at least a $60 million bankroll to spend on these politicians in 2020, Everytown thinks it is in the catbird seat relative to a financially strained and embattled National Rifle Association. The organization, which is funded primarily by failed presidential candidate Michael Bloomberg, believes its anti-gun candidates will win, and win big because they’ve signed on to support legislation that chills the Second Amendment rights of law-abiding citizens.”

Democratic Policies anti-gun

* Democrat Christy Smith was defeated by Republican Mike Garcia in a Special Election on May 12, 2020. Garcia, a former fighter pilot, stated: “It is clear that our message of lower taxes and ensuring we don’t take liberal Sacramento dysfunction to Washington prevailed. I’m ready to go to work right away for the citizens of the 25th Congressional District.” Garcia and Smith, both of Santa Clarita, will face off again on November 3, 2020 to fill a full two-year term in a swing district.
